Battlecreek Puppies, Jolynn and Charles Messerly, hereinafter known as “Seller” do hereby enter into a contract with

“Buyer(s)” with the following stipulations:
The Seller agrees to sell ____________, a Miniature American/Australian Shepherd puppy, hereinafter referred to as
“puppy“:

_____/_____Buyer agrees to provide a life-long commitment, a comfortable environment, prompt medical care, proper
grooming and in general responsible care for the puppy they are purchasing. This includes keeping the puppy/dog
parasite free, up to date on inoculations, proper nutrition which consists of a high quality feed given at regular intervals
and fresh water available at all times. The buyer promises to provide a safe environment for the dog.
_____/_____If at anytime the buyer can no longer care for the dog, the Seller is to be notified and given first option of
resuming full ownership. Refund, if any, will be at the full discretion of the Seller. The dog will be returned with all
paperwork and medical records. The Seller reserves the right to approve/prohibit any transfer of this animal to a third
party.
_____/_____ The Buyer agrees to have their puppy examined by a licensed veterinarian within 5 days of pick up or
delivery. If the puppy does not pass this first examination, and is found to have a life threatening illness or serious
health problem, the puppy may be returned at Buyer’s expense for a full refund with written proof from the veterinarian.
This guarantee does not cover parasites including but not limited to worms, giardia, and coccidiosis. All efforts are
taken to ensure puppies are delivered free of parasites, but due to the high susceptibility of puppies to these parasites
and the factors out of Seller’s control, Seller cannot guarantee puppies to be free of parasites.
_____/_____ The Seller guarantees the puppy to be free of all life threatening congenital diseases. The seller also
guarantees the puppy to be free of any genetic eye disease as well as hip/elbow displasia and luxating patella’s for a
period of 24 months from the date of sale. Should puppy be found to suffer from any health problems covered in this
guarantee, proof from a licensed veterinarian will be required. A comparable puppy with be provided for you from the
next available litter, the original puppy must be returned to me with all registration papers and medical records. As a
breeder I have taken every effort to provide you with a healthy puppy free of health issues, but sometimes even healthy
parents can produce a puppy that has a serious medical condition. Should the puppies condition be so serious as to
require euthanasia, I will provide a replacement puppy of comparable size, color and price. Battlecreek Puppies will not
be responsible for any medical care, or bills. Any injury or illness resulting from poor care is not covered under this
guarantee.
_____/_____ When registering the puppy the Buyer agrees to use the kennel name “Battlecreek’s” in the dogs
registered name.
Agreement for breeding/show quality puppies:
____/____ Buyer agrees to have all appropriate health testing done before breeding the puppy purchased from
Seller. If buying a female, the Buyer agrees not to breed her until at least 18 months of age, and not before a passing
OFA hip prelim or a passing Pennhip clearance and a cerf exam by a licensed veterinarian ophthalmologist has cleared
her for any eye conditions. It is recommended that the dogs MDR1 and PRA/PRCD status, and that of the dog they will
be mated to, be known prior to breeding. If purchasing a male, Buyer agrees not to breed the puppy until he has
reached at least 12 months of age, and has also received his passing OFA hip prelim or passing Pennhip clearance and
has had a cerf exam clearing him of any eye conditions. The dog will be limited to 3 breedings until 24 months of age.
If OFA prelims were done once the puppy has reached 24 months of age a permanent OFA clearance must be
completed to continue breeding and CERF exams kept up to date. If the Seller discovers that the dog was bred without
all the above conditions being met, Seller has the right to immediately resume ownership of the dog and any offspring
produced from a breeding as well as any and all registration paperwork and medical charts. Buyer agrees to pay a
$1500 fee for the unauthorized breeding. Should the Seller have to travel or incur any costs in retrieving the dog, or
securing any paperwork the Buyer agrees to be responsible for all expenses.
_____/_____ Seller does not guarantee that the puppy will make a show dog, or have success in the ring. It is the
Buyer’s job to train the puppy as best they can. The Seller does guarantee the dog against any disqualifying faults.
Should the puppy be found to have a disqualifying fault the puppy may be returned for a comparable replacement
puppy out of the next available litter.
_____/_____ Seller does not guarantee the puppies appropriateness for breeding. The puppy is guaranteed healthy
at time of delivery and to be free of genetic issues. Should Buyer decide after evaluation that the puppy is not
appropriate for breeding for any other reason, that is at the Buyer’s discretion and not the responsibility of the Seller.

Spay/Neuter agreement for pet quality puppies:
_____/_____ It is agreed and understood that the puppy being purchased from Seller is a purebred Miniature
American/Australian Shepherd registerable with _______. By signing this contract Buyer agrees that they will be
receiving limited registration for their puppy.
_____/_____ It is agreed and understood that the puppy is being purchased as a pet and will not be used for breeding.
_____/_____ It is agreed and understood that for the good consideration of a _______ discount on the purchase
price, the buyer is legally obligated to have the pet spayed/neutered. If the buyer fails to spay or neuter their pet
by 9 months of age, the buyer will be obligated to pay the seller an additional _________. Buyer agrees that this fee
does not entitle them to full registration or breeding rights.
_____/_____ It is agreed that the Buyer must provide proof of the spay/neuter having been completed by a qualified
doctor of veterinary medicine, by means of a verifiable receipt or medical chart record, no later then 10 months of age.
_____/_____ It is agreed that, at the Sellers discretion, the Seller can withhold all registration papers until proof has
been delivered to the Seller of spay/neuter.

_____/_____ Should legal action be needed to enforce any portion of this contract by either Buyer or Seller, it is
agreed that the venue will be in Philips County, Montana.
_____/_____ Buyer has placed a deposit in the amount of __________ as a guarantee of purchase. The seller agrees
to hold the puppy in expectation of the pending sale. Should the Buyer be unable to complete this sale for any reason,
this deposit is non refundable and will be retained by the Seller to offset relisting/advertising costs and as compensation
for potential lost sales of the puppy. Should the Buyer and/or Seller decide that this puppy is not an appropriate puppy
for the Buyer, the deposit will be held for a period of up to 6 months towards the purchase of a future puppy, at that
point if a sale has not been finalized, the deposit is non refundable. Should the Seller decide not to complete this sale,
the deposit will be returned to the buyer in full.
This contract is entered into on the ___________day of____________, 20 ___. Both the Buyer and Seller have
